When do I apply for ILR

Hello All,

Hope you are doing well.

I have been continuously resident in the UK since March 2006.

I was on a work permit until January 2010.

I have moved to Tier 1 General in February 2010. I am currently in that migration status.

My spouse has been continuously resident in the UK since September 2010 as a dependent on me.

I would have completed 5 years of continuous residence in the UK in March 2011.

Please confirm whether I could apply for ILR for my spouse and myself in the month of March 2011.

If yes, please confirm when should I be taking the Life in UK Test for ILR.

Additionally, please let me know which documents require submission for ILR.

I will be grateful for any response in this regard.

1. Under current rules, you (self) may apply for settlement no earlier than 28 days before 5th anniversary of your entry in the UK as a WP migrant.
2. Your spouse is not yet eligible for settlement as 319E(d) is not met.
3. KOL required. (245E(d))
4. Please search the forum for list of documents you'll need to submit along with the settlement application. Many successful applicants have posted their success stories, including list of documents they had taken along / submitted.

I thank you for the informative response.

In my query, I had incorrectly stated that my spouse has been resident in the UK as my dependent since September 2010.

My spouse has been resident in the UK as my dependent since September 2006.

Please confirm whether my spouse now meets the requirements of qualifying for an ILR.

Additionally, please confirm how much time ahead of the application should I take the KOL test.
