Though i agree with experts in this forum that spouse must have visa/leave to remain as dependant to qualify for ILR.
but i read somewhere that the rules are applicable when applying separately for ILR but if they are applying together with the main applicant, that it does not matter.
please see below

please read the content of the website above before you comment.
Though this is applicable to turkey but what i want to bring out is this particular statement taken from the website quoted above. It may be applicable to HSMP/work Permit/PBS but it is kept secret from everybody except the caseworkers themselves.it is not fact but just an opinion.

If you are applying separately for settlement, you will need to meet the requirements for coming to join a person living permanently in the United Kingdom.

Dependants applying for permission to remain in the United Kingdom may be penalised if they are not lawfully present in the United Kingdom when the application is made
.
In conclusion,in my own opinion the law does not state that you should meet the requirement of the rules when applying together with the main applicant but one need to have leave to remain/visa excluding visitors visa.

Please it is just opinion,i am not saying this is the fact

It isn't necessarily applicable, there are specificic agreements between Turkey and the UK that do not apply to any other countries.

Plus no other nationality can apply for ECAA. I feel you are grasping at straws.
