ILR application advice

Hi everyone,
I would apprciate your thoughts and advice on the following matter:
I had lived in the UK as a student for 9 years and 7-8 months until May 2010 (when my student visa expired). Just before my visa expiration, I received an offer to start an employment under Tier 2. Therefore, I left the UK before my visa expired, received Tier 2 visa and came back about 3-4 months later (September 2010).
Am I allowed to apply ILR visa or not?
