HSMP posted on 01/04/2006 & got ILR in 4 yrs

Dear Friends,

I have bit critical situation that is as follow.....which hope you to make your decision to apply for ILR.

1) Applied/posted for Initial HSMP on 01/04/2006 (Saturday) via local post office to HSMP UK at 10.30 am. Posted via 1st Class recorded. Payed to Post office via Card to Post HSMP Appli. latter

2) Received HSMP Approval (for 2 Yrs) on 26/04/2006.

3) Visa Stamped from India on 31/05/2006

4) Come to UK on HSMP on 06/07/2006 (Previously was on Student Visa)

5) Extend HSMP May 2008 ( for 3 Yrs)

6) General thinking was that i can apply for ILR after 5 Years of HSMP Stay

7) When i was counting days i.e. total days out of UK then come to know abt the HSMP JR (Judicial Review Documents)

8) I though, i am eligible to apply for ILR after 4 yrs coz i have applied before 03/04/2006 i.e. posted application on 01/04/2006.

9) confusion ??? No proof of postage to Home Office and Bank Statement of 03/2006 checked but transaction of card in post office reflect on 05/04/2006 and HomeOffice transaction shows on 06/04/2006 for £315.00chargen on card according to bank statement.

10) No proof of postage or solid information.

11) Went to bank to find out (Nov 2010) transaction detail i.e. on which date exact Debit Card was used or processed. Bank reply- its very difficult to trace transaction of 4 yrs old. Left copy of bank statement with back office and requesting to find details of tranction, if possible. Bank- we will try. I left bank without any hopes.

12) Request SAR (paid £10) from HomeOffice asking copy of Initial HSMP form and cover of original envelope. Received SAR fm HomeOffice (after 1 month) with all extra Docs. But no postage envelops copy was Missing.

13) SAR Docs- HomeOffice received application on 04/04/2006 (HomeOffice Stamped on Appli Form). No other Docs find useful to prove my Initial Application for HSMP before 03/03/2006.

14) Received Bank Latter mentioning the transaction Details shows-Post office transaction on 01/03/2006 and Home Office transaction on 06/04/2006 (£315.00)

15) Confusion !! Confusion !! Nothing to prove that i have posted my application before 03/04/2006 (befere New rule come for ILR i.e. from 4 to 5 yrs) except bank statment.

16) Decided to take Risk of £ 1250.00 to go ahead with gr8 courage. Went to Croydon PEO in Feb 2011 with all the docs require for ILR and that Bank Statement & bank latter :-). Got wife and Baby but to minimise risk went alone and paid £ 1250.00.

17) Went to HomeOffice by filling SET(O) under HSMP JR form, paid £1250.00 and they(case worker) asked me original HSMP latter then case worker start asking standard question about PR i.e. employment docs, bank statement, P60, Fund Maintenance, Passport, Photo,,,,etc etc

18) Supplied all required information. Case worker counted total days out of UK. Everything was OK.

20) Surprisingly, after looking all docs Case worker said that she is the case worker said that " I am happy to offer you the Indefinite to live in UK (PR) that starting from 06/07/2010. That is Back date, case worker mentioned that your Visa (ILR) will be stamped today will give a Home-Office latter that my ILR will be consider Starting 06/07/2010.

23) Really surprised !!! That the Case Worker did not ask me even single question about when my initial HSMP allocation was posted or received or any proof of postage.

24) Asked abt my wife and baby's Visa. Case Worker said that- if you have bought your wife and baby then, we would have issued visa to them as well But now you have to apply for both of them separately later on.

25) Conclusion ::::::::: If you take risk there might be reward involved in it.

If you apply for ILR under Judicial Review Documents then (I think ) UKBA does not ask you lots of question and quarry it . If you have all the correct documents then I think its worth to take a risk but if possible go to PEO personally, so you can represent yourself or justify yourself.

I applied for hsmp pre nov06 and have to complete 5 years
Now I did have 1 year on SEGS before HSMP and I thought that could be included in the 5 years but apparently not and it has to be WP to be counted.
I am a bit worried about the new changes from 6th april and was thinking shall I take a risk and apply in person anyway and claim 5 years including SEGS and see what they say

What do u think??

SEGS is definitely not accepted. do not take any chance with that particular one. you would almost certainly lose the fee!

SEGS is definitely not accepted. do not take any chance with that particular one. you would almost certainly lose the fee!

would u say that they well check the documents before they charge me the fee if i apply in person and let me know before i pay that SEGS is not counted??

its up to you to take the chance. you are being crazy here.

They do check documents and will likely refuse you at the PEO before you even pay.

But even if you do get through that first check (if the checker makes a mistake that day), when you get to the caseworker, you will be refused ILR. SEGS is clearly not counted.

If you are pre-Nov 2006, the JR of 2008 covers you and you can get ILR at 5 years no matter what they do with immigration laws in the next few months. Why not just wait until you complete 5 years?
