ILR dependent - help needed urgently please

Hi,
I am in the UK under old HSMP (before Apr 2006 and comes under Judicial Review). I got married in Dec 2009 and my wife came to UK on 15th March 2010. I am planning to apply for ILR for both of us (me as main applicant and she as dependent). I read that in order to qualify for ILR dependent, both partners must live together for at least 2 years otherwise ILR would not be granted. Would it be the case in my scenario. Please note that I am on old HSMP rule and this rule might not applicable to me. Please help me as I have booked appointment for 1st March 2011.
