Having read numerous postings as well as the UKBA site my brain is totally scrambled about ESOL and the LitUK Test.

My husband has just passed the first half of his ESOL test entering at Entry Level 3, the second half of his ESOL exam is not until June.

He has just failed his first LitUK Test although studying for weeks.
Since failing recently he has studied 7 days a week including over a coffee in McDonalds whilst in London collecting his new passport yesterday!

Can someone tell me what the ILR visa requirements are please?

We are running out of time for him to pass his LitUK Test, our friend has told us some take the test as many as 13 and 14 times. Our local test centre has told my husband that noone has passed in the last month!! Indeed when my husband took his test all 10 candidates failed. This is making for a very stressed household .....

What should we do if we dont have time for him to do a re-sit before his visa is due? £900 ... errm £972 (6th April) .... is a lot of money to risk over passing a test or not.

Everyone is not the same and some pass on first attempt and some on the next or some might take more attempts.
Did you buy and study the book Life in the UK, it allows you to register online and take as many practice test as you want until you are confident.

which has about 55 papers, if you practise this then there is no reason why you should fail on the next attempt.

We bought the official study book AND the book of tests, he also practises online.

I'm British and only managed to score a very feeble 11 out of 24 though now I am confident I can bore anyone senseless at a party about the UK Govt and European Parliament.... LOL ....

My husband found it easier to listen to the questions through head phones during the test while reading from the screen.
If he is unable to pass the test before his current visa expires, he can apply for an extension on form FLR(M), but this will now require him to take an A1 English test before he applies.

I think you are panicking unnecessarily.

According to this post your husband has until August to apply for settlement.

Also if your husband's English is not at ESOL entry level 3 yet then he can just take the ESOL course with citizenship element. He doesn't also need to do the LITUK test.

Greenie, you state in this post that he has until AUGUST (end of visa date) to apply however in another posting I made you agreed with the Moderator that it should be MAY (month visa granted and of entry) when you followed with the comment 'you don't have to apply 28 days before'.

I am back to being confused. I cant find anything on the UKBA site to guide me and was hoping to find the info here to save my time on the phone.

Can you/someone confirm please?

I've read through the previous post on the link. I know this can be confusing, but the good news is that your husband can apply any time from 28 days before the 2nd anniversary of his original entry date...up until the expiry date of the visa.
So he has until 8th August to apply.

The earliest he can apply is - 28 days before the 2nd anniversary of his entry into UK.
The latest he can apply is - expiry date of his visa, or as the following post suggests, perhaps even after expiry.

If you read my post in your previous thread i clearly said that your husband does not have to apply in may. That is just the earliest date you can apply.
