NEED HELP - CONFUSED - FOR ILR

Hi All,

I am finishing 10 years in this country in Aug 2011 so i can apply for ILR on the basis of long stay.

I was on student visa for 5 years 2 months and 4 years and 8 months on hsmp dependent visa in this country by aug 2011

My wife has been in this country for 1 year on student dependent and she will be finishing 5 year in sept 2011 on HSMP visa (judicial review)

Now i need help to decide :

1.) shall I apply on my wife basis for her only. So just incase if her visa gets rejected than we have another option open
on my 10 years long term stay.

OR

Shall I apply for myself only on long term stay basis and if any problem I can apply on my wife's basis

OR

shall we just apply on any of above and apply for myself and my wife together?

ALSO IF WE APPLY ON HSMP BASIS IN PERSON THAN WHAT THEY CHECK AND ASK AT THE TIME OF INTERVIEW.

1. You cannot include your wife in your (long residence) settlement application.
2. You may however, choose to include yourself as her dependant in her settlement application.
3. Whether you wish to take the HSMP dependant route to settlement or the long residence route to settlement is entirely your choice.
4. Your wife presently has only one route to settlement - as an economic migrant.

And, please don't shout.

hi Shushd,

Thank you very much for you response and taking interest in in my problem.

If we apply on my wife's hsmp (judical review) base and myself as dependent than just in case if our visa get rejected can I still apply for ILR on my long term basis OR I will have no option and have to go back home ?


Please shed more light on this

1. When does your current leave expire?
2. When does your wife's current leave expire?
3. Why do you believe your wife's settlement application will be refused? A valid reason .. or just a worry?
