ILR Salary Criteria Help - New Rules

Dear All,
Appreciate your good work Forum!!!
As per the new rules, I may need some suggestions regarding my ILR as it states Tier 1 (General) migrants will need to meet the same income criteria that applied when they last extended their permission to stay in the UK
I showed my income criteria as 40 points in Tier1 which was salary + extra work (Its like a blessing became a sin)..
Just because I got extra work, extra money, I happened to fall in higher income category, nearly earning 1k more
Now that my salary is the same, but I had no extra work, so no extra pay…
I fall into 35 points, (1k less than 35,000)
Can anybody plz suggest me any advice as I am due my ILR in august ending

My understanding is NOT THE SAME INCOME LEVEL, rather same minimum qualifying points score existing at the extension stage

This was on the UK HO Website.
I meant to say that for my Tier 1 extension, I scored 40 points, but now I am able to score only 35 points.
Does this make my application rejected i.e, Do I meet the salary criteria

Please refer the Draft version of Immigration Directorate Instruction(d)
If the applicant has or has had leave as a Highly Skilled Migrant, a Writer, Composer or
Artist, a Self-employed Lawyer or as a Tier 1 (General) Migrant under the rules in place
before 19 July 2010, and has not been granted leave in any categories other than these
under the rules in place since 19 July 2010, the applicant must have 75 points under
paragraphs 7 to 34 of Appendix As item d

an applicant applying for leave to remain or indefinite leave to remain as a Tier 1 (General) Migrant
must score 75 points for attributes, if the applicant has, or has had, leave as a Highly skilled Migrant, as
a Writer, Composer or artist, self-employed lawyer, or as a Tier 1 (General) Migrant under the rules in
place before 19 July 2010, and has not been granted leave in any categories other than these under the rules
in place since 19 July 2010.
If that's the case, then I can qualify for ILR, coz I score more than 75 points.
I was worried when I saw this statement

can you please inform whether you got ILR at the end?
need to know about the salary criteria.

All you need is to score 75b points based on the criteria that applied to you when you first made your initial HSMP/tier 1 application. My understanding is that if you still score 75 points based on your current status, then you have met the requirements for ILR and can apply.
