i just saw this new section :


2.2 Applications that fall short of the five year continuous period
In some cases, applicants may have been granted 5 years continuous leave, but will not have spent 5 years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the 5 years, provided this period was not longer than 3 months.


I am lil confused, and wanted to confirm that i was granted visa on 2nd june 2010 and i came to Uk on 18th august 2010, which is after 2months 16days....as per new rule would i be elligible to file for ILR after 5 years as they would count my entrance since it is less than three months?????

True . You 2 months and 16 days will be considered in 5 years provided your visa expires on 2nd jun 2015. If your visa is until 18th Aug 2015 then that period will be automatically excluded.

Answer is yes as per current rules. Keep eye on ILR rules near the time of your ILR application.

Is this 3 month rule valid for the case below?

WP Entry clearance Stamped: 20/06/06. WP visa was initially granted for 2 years.

Entered in UK on WP: 10/09/06 i.e. entered within 3 months ( gap of approximately 80 days).

Switched over to Tier 1 General: 2 April 2008

Tier 1 Extension done: 11 March 2011 valid up to 11 March 2013.


So i am right in saying that I complete 5 years on 20/6/11? and can I apply 28 days before 20/6/11?

From the date i entered in UK, i already spent 175 days outside UK till date . Does one need to account 80 days above, from the entry clearance and date of entry, as an absence?

any advise on above please?

You may apply for ILR from Saturday, 13 August 2011.

Yes as long as you travel within 90 days , You can apply for ILR.
