I entered the country on 01-Feb-2007 on a work permit; still with the same company & don't intend to switch; switched the Visa from WP to T1G in Sep-10 (which is valid until Sep-12); hoping to apply for ILR in Jan-12.

During the past 5 years, apart from paid vacations, I did a lot of business travel mostly during 2009 (3-4 days a week out of UK for about a year).

Here are my questions:

1) As per my calculations, here is total of my absences from UK:
a) Business trips: 209 days
b) Paid Vacations: 93 days
c) The longest single trip was 34 days
d) All the above numbers exclude days of travel
What documentation can I provide so that it doesn't impact my application negatively? Would a letter from the employer stating the nature of my job requires travel be enough? Or do I need my employer to acknowledge the date of each and every trip in writing?

2) Because of more than 180 days absence in total, does this mean that I cannot apply in person? (I appreciate its too early for me to be asking this but would be interested in knowing)

3) I've always received salary in UK & paid taxes here since 01-Feb-2007; never been out on an unpaid leave; is this enough for being classified as 'economically active in UK' for continuous 5 years?

4) Has anyone used SAR to get a list of all entries and exits from the country? (especially for determining absences for ILR)

5) When should I take the KOL test? Do the results have a validity?

Any other thoughts suggestions would be greatly appreciated.

Yes, at least for business trips if not for paid leave(s). Check the sticky topics for template(s).

You can, but in-person application is not a guarantee of same day service.

Yes.

Any time (if applying at PEO, the latest you can take the test is 2 working days before the appointment). Test results are valid for life. If you lose the certificate then you'll need to take the test again.

I will be grateful if you could reply tomy querry.

1. I was given Dependent HSMP visa for 2 years in Nov 2007 which we extended for another 3 years which is now valid till nov 2012.

I have lost the job and now found another good job in middle east. The rules for ILR dependents say that they have complted atleast two year stay which I have done. I am planning to move out to middle east now. I have 90 holidays a year which i can use regularly for visit.

When I apply for ILR with in my family in nov 2102 will there be any probelm as I may be absent from UK most of the time. Any suitable way I can plan in advance.

Hi sushdmehta, since you mentioned unpaid leave is being mentioned I have a quick question. I am on the same employer for the last 5 years. I had maybe 20 at most unpaid leave and ot of uk for personal reasons but always been empliyed. That shouldnt be a problem for 5 year continous period crteria ?
