ILR refused - Set(M)

Hi!
Please can you give us some assistance on what our next step should be.
My husband came to the UK in April 2008, on a two year visa as a spouse. He applied for ILR last year August 2010 and was given 3 years discretionary leave. His application was refused on the basis of his ESOL qualification not from an accredited college. Now he is studying his ESOL qualification in an accredited institute but does he apply for ILR or what are his options?
Furthermore We now have a daughter and I have been getting child benefit and child tax credit, will this harm is next application? I don't claim working tax credit.
