ILR date of applying?

Hi,
I got hsmp entry clearnce stamped on 27th June 2006. But entered in the UK on 10th August 2006. I got my Tier 1 extended in Aug 2008 and visa stamped as Tier 1 till 5 Aug 2011 (under hsmp JR).
Now, am I eligible to apply for ILR under HSMP JR 2009 after 13th July (28 days before 10aug; date on entry?)
Also, there is no stamping of visa between 27th June 2008 till 5th aug 2008 as my application and documents were with HO for hsmp/T1 extension.
Is that fine?
