break in residency

Hi,
i thinking of applying for ILR based on 10 year long residency. all my visa application been on time. but i last one was refused so i appeal and before the appeal was heard, i made a fresh application. i was latter on asked my ukba to withdraw the appeal before they decide on the new application. i send a withdrawal letter to the tribunal n the ukba. then 2weeks latter i received my visa and tribunal also refused the withdrawal of the appeal, claiming they have already decided on the appeal n refused. both letters came the sameday. i would like to know if they is a break in my 10 years.

I think there is, if the apeal was refused, however, it would have been different if it was accepted IMHO.

Thanks. Do think I should apply since they allow 10 days if the break is only once and since the tribunal decision came on the 16th n my visa came on the 18th. Any suggestion? Thanks
