Tax refund advice-old hsmp ILR Application

Little technical

One of my cliet came on old HSMP Dec 04 letter (case 1+3+3 Year)

left country on medical groound from Aug 5 to Jan 7

applied ILR in Dec 09 , refused on ground of long leave and non economic active during medical leave , HO gave reason that NHS not told u to go for medical out of country u went at yr accord , even though he have all letters from NHS and indian doctors for his back issues.

now this guy came to me asking to claim back his tax paid in from April 5 to July 5 , Jan 7 to march 7 , as he was less than 182 days in that two accounting years ,

as per tax man he can claim that tax paid but

he asked his advice on this effect on his next ILR application in dec 11 as he is completing his 4 year again from Jan 7 to Dec 11

tax aman point of view i am confident he will get refund , will it impact on his ILR , he says HO already trated him non economic in that period

WILL HE get one time cost of extension , whic was approved by hsmp jr

for one time payment in case of 1+3+3 hsmp jr in above case
