ILR or FLR(M) for Dependent

Hi All,


My Wife is my HSMP T1 dependent since November, 2009 which was originally expiring in 2013. But I have now got my ILR approved under the 10 year in April 2011.

1) Now my first question is, since my wife would be living in UK as my dependent for 2 years by November 2011, do I still need apply for FLR(M) first for her or can directly apply for ILR in November. I am trying to save the fee and time if this is allowed that is.

2)I am not sure whether this information would be useful or not, we had a child last August and would be applying for our baby's registration as a citizen under 1(3) through MN1 form. Would this have any levy on my wife's application?

3) Is my wife committing any crime by not switching to FLR(M) while she would wait for her two years in UK?

We both are Pakistani Nationals.

As always, I would be extremely grateful for your advice.

Apologies if this question has been asked earlier. I have tried to look for it but no luck.

Hi There,

I called HO and they advised me that in order to make up for 2 years she would first have to get her visa switched into FLR(M) for six months and then she could apply for settlement.

This is somewhat a different advice which was given to me earlier by HO itself. I have noted down the time and duration of the call.

Shall call them after six months to see what happens. Right now, I am planning to apply for my wife's FLR (M) as I am hoping to get her English certificate soon.
