10years ILR with 2Dependents(wife and baby)

Hi All

Soon I will be elgible for ILR on 10years but I got big confusion, I read in the ILR 10year rules that my dependents cannont apply with me, they have to apply separatley, on FLR(M) but my question is with out Iam getting my ILR how my dependents will apply. one more thing my visa validity date just finish 2weeks after my 10years stay in the country.

can any experts who got knowledge about how to apply with dependents under 10years rule please help me out so that I will be very greatfull.

Post a valid FLR(M) application together with your valid Long residence SET(O) application before leave expires. Enclose a covering letter linking the FLR(M) with your Long residence application. Request that they consider your Long residence application first. A1 test required for FLR(M). KOL required for ILR.

Baby, if born in the UK, does not need to make an application for leave to remain.

I am in a similar situation but no children.

I have posted my SET-O (10 years Long Residence) and FLR(M) for my wife on 18.07.11. You can check my post to see what I've included in my ILR and wife's FLR(M) applications.

If the dependant partner's leave is soon expiring and the dependant partner does not qualify for any other category, then there isn't really another option other than to apply for FLR(M) before leave expires, as suggested in the SET(O) guidelines.

If the ILR is granted, then FLR(M) is the appropriate application.
Refusal, which results in no leave remaining, will attract the right of appeal.
