Hi guys,

My husband got his spouse visa last year on 17th May 2010 valid until 17th Aug 2012. However he flew to me in UK on 24th May 2010.

I understood it that he should apply for ILR no earlier than 28 days before the expiry of his visa, i.e 28 days before 17th August 2012.

However I have since been told that as he entered on 24th May 2010 he can apply 28 days before this date? Is this correct please?

I had thought all along it was before 17th Aug 2012, but this has worried me. We don't want to waste money applying before he is eligible.

No earlier than 28 days before May 10th 2012 and any time from then before the expiry date of August 17th 2012.

Could it be 28 days before 24th May 2012 as he would complete 2 years by 24 May 2012
