ILR query-break appeared during HSMP to Tier 1 conversion

Dear all,
I came to UK on 5 September 2003 on student visa which I converted into HSMP on 13 May 2007. HSMP was due to expire on 13 May 2009 and I applied for Tier 1 general prior to HSMP expiry date. However I gave wrong bank account details on my application form, hence my application was not considered and returned to me in June 2009 after my HSMP had expired with no right to appeal. I reapplied with correct bank account details in July 2009 and was given Tier 1 General visa on 13th August 2009 which is due to expire on 13th August 2012.
Do I qualify for ILR in August 2012 or should I need to reapply for Tier 1 Gen. extension?
Many Thanks for your help!

You can apply from April (up to 28 days before May 13) 2012

Just to ensure that my visa break from 1st June til 12th August 2009 will not stop me from qualifying for ILR.
Thanks again,

You acted immediately to make a correction (and within 28 days). It will be better to indicate, in the application notes, the events as they happened (but just have you have done here using the same wording) but otherwise you should be fine.

I think the gap between visa rejection and me reapplying was more than 28days (approx 6-7 weeks). I reapplied on 22nd July and was granted visa 3 weeks later starting from 13th August 2009.
Is that going to be an issue?? I'm sorry for too many question but being been burnt once means that I want to understand the whole process in correct way so I don't make any error this time.
Many Thanks,
Tushar

Hi,
I am also in similar situation in 2010 after they changed the form for dependent. If you can share what have you decided, many in this forum could get benefited.

All,
In actual fact there was no break as you did not leave the UK after your application was refused due to typographical error.
Explain your circumstances in a cover letter and attach the refusal letter stating that you wrongly filled in an incorrect bank details and also include the approval letter you received from HO after sending the correct information or application. Ensure that the total years spent in the UK so far is 4 years if your applying as ILR(JR) or 5 years for Tier (1) and also make sure that you send the application not more than 28 days before your current LTR expires.
I believe you should be alright or ok.
I hope this helps & wishing you all the best.
Regards, 1971.
