ILR - Qualifying period.

Hello Friends,

Please advise

I got 5 yr workpermit on 9th jan 2007 to 9th Jan 2012.

On 14th April I joined NHS and they applied for my fresh workpermit for 5 years
which start 10th sept 2008 to 10sept 2013.

There are no gaps in my employment and i worked as per rules.

I want to know my qualifying period is 28 days before 9th jan 2012.
Can I apply Just after 9th Dec 2011?

There may be a problem with the period between 14 April and 10 Sept 2008, if you changed employment before new work permit was granted.

Thanks Vinay,

In my case there is no service break my 1st workpermit was issued for 5 years.
There is no change in my job role.
I changed the job and my new employer informed the homeoffice for fresh workpermit for 5 years.

Anyone from forum has more information regarding this.

The answer has already been provided.

If you commenced working with your (new, NHS) employer on 14Apr before a valid leave (for employment under the new, NHS employer) was issued in your passport, then you were in breach of immigration laws between 14Apr and 10Sep.

Hi Sushdmehta,

My new employer after getting clearance from Home office appointed me for the new job.I got lthis letter on 4th April 2008
This letter advise that I can start my new job and also advise to apply for new leave to remain in UK within 6 months and rightly I got new leave to remin stamp on my pasport which start 10th sept 2008 to 10sept 2013. (within 6 months)

I think I fulfill all the requirements necessary for chang of job.

If this letter was issued by Home Office and states what you say, then you should be fine. Do include this letter with your application.

Just for clarification,in this case I can apply 28 days before 9th jan 2012.
Can I apply Just after 9th Dec 2011?
Do I need to take my family with me?
