I got Tier1 visa till June 2013 but I am completing my 5 years in jan 2013 and hopefully will apply for ILR in DEC 2012. My family got dependents Visa till June 2013 so My questions are
1- Can I apply for ILR for my self only in Dec 2012 (Premium service).
2- If I get ILR , Can my family later apply for ILR as a dependent of settled person in UK.
3- Does it make any difference cost wise.
4- Don’t you think It might be a problem to apply as a dependents of Settled person as their current visa status is dependents of Tier1.

1. Yes
2. Yes
3. Yes. Applying seperately would cost more, however if it is by post then you could save some money. You have to calculate the exact amount which depends on the number of your dependants / applicants applying seperately.
4. No. But please bear in mind that you might have to change their visa status after you get your ILR.
Its a long way to your ILR. Rules and fee might change by then you never know. So just wait and see.

Rules will change, so best to wait. However its
not a good idea to apply separately, try and apply at the same time whether by post or at PEO.

It's not possible for PBS dependants (meaning those under the immigration status of a PBS dependant) to apply for ILR separately . The rules offer no scope for this. If your dependant does not apply jointly with you on the same application form (and for this she needs to have been married and lived in the UK for two years) she will have to switch into leave to remain under paragraph 284 of the rules using FLR(M) and then apply for ILR.
