ILR Success Complicated Case

Hi

Just wanted to share my experience of ILR- HSMP JR Pre Nov. 2006.

Total Applicants=3 (2 adults + 1 child who was born in UK)

Before I start just few notes on the complications I had with my case:

1. 8 points given by court on Nov. 2009 for an offence occurred in Sept. 2006.

2. Lost Passports (only two adults) last years, replacement issued this year. Luckily had copies of old passports and visas.

3. No police reports as where I live police do not issue reports for lost passports as they seem passports can be tracked.

4. On TOC on new passports UKBA issued BRP with incorrect valid until dates, 7 weeks before it was on old passports.

5. Sent atleast 10 reminders to UKBA for correction of dates on BRP, no response for any of them.

It starts here now.

Because of above issues decided to go to Solihull so that I do not waste £2700, booked in person early morning. Went myself only for a family appointment.

Arrived on time and went through all steps and went to case worker.

First question: Any conviction, I explained point 1 above. Caseworker told me that I can not apply for ILR as it is not clear yet, needs to be 5 years from conviction not from offence. I went on explaining that as I am a JR applicant so new criminality threshold should not apply to me. Had an argument and finally after discussing policy in detail (took a copy with me) and discussing with a senior they agreed.

Second questions: Where are the old passports. I explained point 2 above. I was told that they do not accept copies and original is the only way they can check my absences in UK. Again explained that I have lost them and even new passports says at the back that they are lost and have old passport numbers on them. I had copies of everything so absence can be verified. I was like hitting a wall as how can bring lost originals. She went off to see caseworker and came back with the same answer. At the end, I was told apply by post as in postal application, they can perform more detailed checks. Sent out and no fees taken.

My impression so far, case worker was not interested in my case for some reason.

Well phoned my solicitor and he told me that I do not have any other option and apply by post.

Listen to you gut and never give up. I listened and decided I am not giving up. I decided to gamble with £2700.

Phoned and asked for available appointment at Croydon, they told me next day. I asked what about same day. 2 appointments available and got the later one. Had to run like a headless chicken to ensure I arrive on time. Thanks to all trains on time, I was on time.

Went through normal checks and to reception, looked at form; BRP and she asked about previous passports. I explained and she saw copies and stamped application valid and asked to pay.

Paid in next five minutes and than wait for 2 hours before I was called.

First question: Do you have copies of everything. I said Yes.

Second questions: I just need copies and do not give me any originals. I smiled and said no problems.

I was asked for (copies only, unless stated):

1. New passports and copies.
2. Photos-original
3. form- original
4. 3 months payslip
5. 3 months bank statement
6. 5 years P60 (I had only last 2, no problem)
7. Letter from employer
8. Documents that me and wife are living together.


I was asked to go back to seating area and waited to be called (I was bit surprised as everyone else was sitting opposite to window during decision).

15 minutes later, guy waived and asked to come back and asked about conviction, I explained and told him I have mentioned on the form as I was not sure to write or not. He kept quite and told to go back.

15 minutes latter waived again and asked for old passport and visa copies, gave him without any question answer session and he sent me back again.

Called back in 10 minutes and was told application is successful and collect passports when customer service call my number and was called in 5 minutes for collection.

What I have learnt from my experience:

1. It all depends on caseworker.

2. Be prepared, I started my preparation almost 6 months ago and had everything they possibly could ask.

3. Never give up, if you do, it's only you who will loose as no one else give a damn s***

4. Any finally, help each other. I would like to thank everyone who shared experience and advise on this forum which really helped me to prepare my case and hope that my experience will someone as well.

Congrats on your success.
What were the convictions by Court? Are they Trafic related?

i think you are the brave one , you took the risk of £2700 and you got it.
no doubt you are an example one can follow

Bobby: It was a traffic offence back in Sept. 2006 and which was only convicted in Nov. 2009 because court keep using incorrect address while sending letters. Funny enough when they gave me point, it was already over three years after which points clear anyways.

Genious: I thought about that at the time,I was thinking like if they say we can't decide today than it would have gone through postal route anyways.

Congrats for ILR success.. Can you please tell me what sort of documents you have mentioned related "8. Documents that me and wife are living together. ".

yousuf I did not count the number but for me it was bank statement which he just asked at the start (last three months only) and for her I gave couple of bank statement and an old communication letter from her employer.
