salary band change before ILR application

Hi all,

I appreciate your advice in this issue please.

If the my salary band, at the time of applying for ILR, is lower than the one used for Tier 1 extension (due to job change), is this a problem that could affect my application for ILR? I still can claim 75 points form table 2 in App A. or do i need to meet the previous salary band for my extension?

This is quite controversial question on this forum in the past. I have seen atleast one poster whose visa was refused and he says it was because his salary was not in the same band as when he was on Tier-1.

There are others who have posted success stories on this forum who have successfully obtained ILR with lower income band.

But I think according to law you just need 75 points. I am sure somebody will answer it soon.

As a Tier 1 (General) migrant, your eligibility to settlement will be assessed on the basis of points (scored against various attributes) and not just on an XYZ amount of annual income or a salary band.

If you score the necessary points, your settlement application cannot be refused for the reason that your previous earnings have fallen as compared to what they were at the time of your extension application.
