ILR Fast trak returned

I made an ILR application on the SET (O) Form by fast trak on the 25th Oct. This was done by an agency G.V. (work that one out, I don't want to name any names directly) and it was returned on the 26th Oct as the UKBA said it had to be done by post. My previous visa (residence visa) expired on the 28th Oct.
My application is based on access to a child as I am no longer married to my British ex-wife but both my children were born in the UK.

I have asked that my application be expedited as I need to be in Canada on the 11th November for my wedding. We only planned the wedding date after being told that we could make a fast trak application and that I would have my passport and ILR visa back on the 26th.

Currently I have a Ref No. and payment has been taken.....waiting on tender hooks.

Unfortunately, an application which requires further checks by more senior caseworkers and can't be decided on the day at a PEO (which I assume you mean by 'fast-track'), will now join the postal queue , with no special priority.
A wedding date won't be considered as 'exceptional compassionate grounds' for expediting the application.
The legal rep should have been aware that an application for ILR on the grounds of continuing access to a child, wouldn't be considered as a straightforward submission...which is what PEO appointments are for, whether submitted by the applicant or a legal advisor.
When you say 'residence visa'...which category of visa are you referring to?

I originally had a spousal visa and then had to apply for a one year residents visa based on access to a child. I have asked for the ILR visa to be expedited as it was the Home Office who advised us on three separate occasions that we could apply in person (fast trak)

UKBA contact centre service is known to ill-advise people.
Unfortunately, all you can do is hope that UKBA accepts your request for expediting the application decision.
