Elegibility for ILR

Hello,

Can you please advise on my situation :

1. Received work permit on : 08 - Jan 2008; expires on 08- Jan 2013
Entered UK on : 30 Jan 2008
When can I apply for ILR

2. I have been employed with the same company and all my salaries paid into UK. However, I was sent on an assignment to US for 177 days; and I did not leave US during this period.

There were other multiple business trips to various countries all varying from 2 weeks to 2 months.

If I get a letter from my employer stating that all these trips were for business purpose, will I be considered for ILR.

Guys,

Quick update...

I applied for ILR via same day route in December 2013 inspite of my 178 day trip to the US and me being out of the country for more than 500 days.

The application was deferred and then rejected in March with full right to appeal.

I appealed against the decision - had hearing in August at Birmingham Sheldon and the appeal was allowed on the basis that there could be no publlic interest in removing from the country (Human Rights).

My solicitor has now been informed that I will be getting my ILR this month as UKBA did not appeal against first tier tribunal decision.

Moral of the story: UKBA caseworkers do not really care about you or your job - for them it is just another application rejection - however this should not discourage people from applying for ILR as the courts are fair and unbiased and will listen to any reasonable argument.
