ILR gap

Hi all,

I have recently got my ILR back and am very glad. My friend is about to send her passport to apply for the ILR but she's not sure the gap she has will cause a problem. Here's her case:

9 1/2 student visa, then went onto PSW. When she was renewing her student visa a couple of years ago, the whole application pack was returned to her because her photos didn't meet the requirement. Her visa expired on the 31/10/2009. She sent it on the 23/10 (which was fine) but the pack was sent back to her in around the 17/11 and she returned new photographs along with the original application on the 20/11. Visa was stamped and passport returned to her in around mid January 2010.

That would have counted as a gap she assumed and she's panicking now. Any of you guys had similar experience? And how did you tackle that?

should be fine I'd imagine, would be good of her to show her first application was sent back, I think they would see this as fine if just once and also maybe appealable...

Others would have more of a clue than me though.
