SET(O) query - B3 (Page 19)

Hi All,


I have applied for tier-i in feb 2009 and got Tier-i in apr 2009. That time home office awared 30 points for my bachelor degree. Now i am eligible for applying for ILR ( WP + TIER 1 = Total 5 years). But i am confused about point B3 ( page 19 ) of form SET(O).Given below.

Last line worries me a lot. Is that means i will not get 30 points now , when i will apply for ILR??

B3. Please indicate the points being claimed for your qualification, including equivalent professional/vocational qualifications:

Applications for indefinite leave to remain where you have had leave as a Highly Skilled Migrant, Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the Rules in place before 6 April 2010

Bachelor’s degree* 30 points
Master’s degree 35 points
PhD 50 points

You can only claim points for a Bachelor’s degree level qualification if you have previously been granted leave to enter or remain as a Tier 1 (General) migrant under the rules in place before 31 March 2009 or after 5 April 2010; or as a Highly Skilled Migrant, Writer, Composer or Artist or a self employed lawyer.

Why are you worried? You are no affected by this anyway. There was a time, as mentioned in the form, when points for Bachelors degree were not awarded but you dont fall in that as clearly you got the points when you initially applied for T1G.

@mk357- why you are saying i dont fall in that category? I didnt got you.

Got tier-i in apr-2009 and this is within that period (i.e. mar2009 to apr-2010)

Don't worry, your initail claimed points will go till end. The HSMP or Tier 1 approval letter tells you how much points you have scored in the attributes. You can use that letter as a proof of your claiming the point again for your ILR.

Secondly, please read the rule again. Its says you will be awarded points for your bachelor degree if you have applied before 31 Mar 2009. Since you have applied in Feb 2009. So you will be OK.

The points are awarded according to the rules in place at the time of submitting the application. NOT on when it is decided.

So you are safe...

1)where it is mentioned that points will be awarded if applied before 31 mar 2009.

2)how can i prove that i had applied in feb 2009. I applied through post and dont have any receipts at this moment.

1. Please read page 6 of the IDI. It will show you the breakdown of awarding of point.

2. You don't need to have that receipt with you. You must have the approval letter when you received your passport. That letter give you your date of application and the scoring criteria date. In addition to this, since you had been awarded the points of education, now you don't have to worry about that. If you would have applied after 6 April 2010. then you had not got 30 points for your Bachelor degree.

I have already told you. You are fine. Just don't panic....

Zahid.ali.anwar is right, you will be awrded points. take the TIER1 approval letter along with you.My case was the same, I APPLIED in feb 2009 but RECIVED my passport in may 2009 , and was awarded bachelor;s degreee points without even providing evidence again.
