Help with Set (m) form

Hello, I need some advice with applying for settlement. I first came to the uk on an ancestry visa which I had from approx. may 2006 to jan 2010. Then I was married to a uk citizen and we got advice to change to a spouse visa which was granted. This is ending 22 jan. i understand that i can apply for permanent residency but i am worried it will be refused as I am unemployed and my husband is on benefit. We live with his mother and have managed in this way for five and a half years now. Do we have any chance of getting permanent residency? I thought i had better check before we send the form in. Is there any other option, I have tried to find out about extending the spouse visa but found nothing. I hope that someone can help!

You don't need to extend the visa. To put your mind at rest, UKBA case workers are advised not to refuse spouse ILR applications due to lack of finance alone. The focus is on whether the marriage is continuing. If you are living with your mother-in-law, do you have correspondence/bills etc addressed to you and your husband...either in joint or separate names?
Have you passed the Life in the UK test or completed an approved ESOL course?
