SET (O) Queries

Gurus,

Helllpppppp!! :)

1) Due to delayed travel to the UK after entry clearance, I have not been able to complete 5 years (few weeks shortfall) but I may still be granted an ILR as per the rules. However, I don't see any section in the form to explain this situation. Should I attach a separate cover letter?

2) Should I staple the form?

3) Section 6.2 (absence sheet): I have too many entries to put in that would not all get into the table provided in form. Do I need to fill in the table provided before continuing on separate sheet or just leave the table empty and just attach a sheet?

Thank you very much for your help guys!

1) As you have a shortfall of only few weeks, you should be fine, regarding this document:

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

It says:

In some cases, applicants may have been granted five years continuous leave, but due to delayed travel will not have spent five years continuously in the UK before their current leave expires. Caseworkers may count the period between entry clearance being granted and the date the applicant entered the UK towards the five years, provided this period was not longer than three months.

2) I didn't staple it and it was ok. Case worker put all sheets together with binder clip.

3) I filled the table in the form and continued on the separate sheet (which I signed). Additionally, I provided another version of the table (on another signed sheet): one with all absences with number of days for each of them and with the total number of days (the sum). Case worker took both sheets.

Thank you very much mate, much appreciated!

Regarding 1), do we have to explicitly explain the situation to the case worker?

I entered UK 11 days after I got visa and applied within 28 days window before 5th anniversary of my arrival to UK so didn't have shortfall and cannot answer this question from my experience but I believe case worker won't ask you anything if your shortfall is only few weeks. If asked though, tell the truth (you had notice period in previous company/needed time to arrange things at home before moving/needed time to arrange accommodation, moving...).
