ILR Salary(earnings) requirement for thos HSMP + Tier 1 Visa

Moderators / Senior Members - Please can anyone kindly clarify?

Here is my situation:

EC HSMP Stamped in India: 31-August-2007 (initial visa given for 2 yrs)
First Time entered in UK: 24-October-2007
Extended & Switched to Tier 1 General: May 2009 (visa given till 31-August-2012) - At this time I scored 45 points for my salary.

I am quite clear that, even though I entered 54 days late from my initial EC HSMP visa, I can still go ahead and apply for my ILR by August 6th 2012.

But, my whole confusion is about EARNINGS Requirement for ILR Application.

Settlement Tier 1 Criteria[/url].

Here in page # 6 & 7, I am not sure which table is applicable for me for previous earnings?.

Please can any one clarify by throwing some light on the facts?

Table 2,applies to you. You'll be able to claim, 45 points for your earnings if >40K.

For your second question as the gap between your entry clearance and first arrival to UK is less than 90 days, you will be able to apply on the 5th anniversary of your Entry Clearance. (The law changed last year, see the link below).

I have used www.timeanddate.com to calculate 28 days before the 5th anniversary of your EC. You should be able to apply any day on or after 03rd August 2012.

Can you please also clarify the age factor? On Page 6, in the Age column - alongside it is written as "at date of application for first grant" ... does it mean hsmp or tier 1 (as I was on HSMP initially and after 2 years switched and extended my visa to Tier 1 General?

first grant would be your hsmp visa (which you got before Tier-1)
