Hello All,

I am a Nigerien and married to a british citizen.
We have been married for 5 years and have 3 children.
She gave birth in July and stayed back with the baby and she got a 2 bedroom apartment. She is currently in the Uk with our 3 boys.
She is currently with the 3 boys in the UK but is not working because of the age of the baby.
I want to apply for my UK settlement visa to enable me join her and my children to live and work in the UK.
She is presently on Housing Benefit, Chikd tax credit and Income support.
I live and work in Niamey in Niger. Am I entitled to ILR?
What documents do I need to submit with my application and what docs do i get from my wife?
What effects does the benefits have on my application?

You first need to get a 2 years spouse visa and once you have completed 2 years in UK, you can apply for ILR (provided you have passed LiUK test).

But we have been married 5 years prior to my applying.

You would need to have been married for a minimum of 4 years and living together outside of the UK during this time. Therefore you don't qualify for ILE.
How will you show that your wife won't need to claim additional benefits if you join her?

Thanks @ Casa
Yes we have been married and lived outside the UK for over 4 years prior to my application. We clocked 4 years marriage in July 2010.

Secondly, I have savings of about 8,000 pounds.

Please advise.

@Greenie
No I am yet to write the Life In the UK Test.

@casa
My wife has been in the UK since July 2011. But I was in the UK in October where I spent 2 weeks with her.
