urgent reply please : total duration outside uk in a year

Dear Members,

This is one of the query on behalf of my friend.

I understand that a person can live outside the UK less than 90 days. But my question is, if a person makes two or three trips in a year and all his absences are less than 90 days. say 70 + 30 + 35 days, Will it effect the ILR or reset the ILR by any mean? I know in total a person cannot exceed the 180 days limit in 5 years.

Please if anybody can confirm, is it possible to do a trip twice or thrice in a year but less than 90 days in each trip?

the answer to your question is yes. It only says that a single trip should not be more than 90 days. Having said that if you are outside the country for a longer duration within a year then it is considered to be unpaid leave and this might cause problems if you cannot justify your absence with proper evidence.

Remember it is case workers discretion to evaluate and judge the long period of stay outside UK within a year. Hope this helps.

Thanks very much. I did not find any documentation which says what is the limit within the year. Is there any document where i can find information about it?
