ILR - More than 180 days outside UK - Am I eligible?

Hi,

I entered UK in Sep 2007 through WP with validity for 3 years. I went back to India for some health issues in May 2009. My visa was also due to expire so my employer insisted in getting my visa renewed at India. I traveled back to UK after 2 months (July 2009) through a Tier2- Intra Company Transfer Visa. This visa was issued even before my previous WP got expired (my previous WP expires in July 2009; while my new Tier2 Intra Company Transfer visa was issued in June 2009). Later, I switched to Tier1 in Dec 2009.

I have traveled outside UK for 193 days (165 days - holidays; 28 - Business Trip). I have not stayed more than 65 days in a single trip.

According to the rules mentioned in the UK Home Office website, I have stayed more than 180 days (i.e. exceeds by 13 days). Would this cause me problems while applying for ILR this year? I have read some stories in some forums, where some have been really successful in getting ILR when the days out of UK is more than 180 days.

Please do let me know if I am eligible for ILR. Is the success rate for ILR more when the case is submitted through Immigration lawyers or solicitors? I would really appreciate any help in this matter.

I have 193 days out as well, include 43 days paid leave and the others are personal leave. no single leave over 21 days. can anyone help? thanks

Did you had any feedback from seniour members?

Have you resolved the issue? Do you have any experience you want to share on forum?

Hi pboopa,

Your case is absolutely fine. As business trips should be excluded just provide a letter for the business related absence from employer.

Hi mat101, I have got my ILR in March, my expeience is that they don't really care the days if you are less than 200 days and you don't have sigle leave more than 90 days. in my case, the CW didn't even look into the leave details, although I handed in a spreadsheet.
