Hi Experts,

I am planning to go for my ILR in March 1st week (currently on Tier1 extension) and had the following queries, if you could kindly answer -

i) Presume I dont need to include my child who is born in UK in my application even though he has a Tier1 dependent visa, is that correct?

ii) Can I include my wife who is here on Tier2 since 2009 as my dependent in the ILR application if I shift her as my Tier 1 dependent?

iii) If yes, would she need to do an entry clearance from outside UK or can she do from within UK (she is currently inside UK).

Thanks in anticipation!
Ravi.

Thanks Vinni,

Just on Point 2 around filing my wife's dependent from outside UK which you have now confirmed (thanks!), is there any requirement for her to be on my dependent visa for LAST 2 years? If it is, then obviously this would lead to her ILR rejection.

I also wanted to ask that if for any reason one of the dependents is not given an ILR (like my wife), would that mean a rejection for primary applicant as well (myself). This I ask coz is it possible for me to have an ILR and my wife to still be on a Tier1 dependent if she is not granted ILR.

I am under the current impression ILR is given based on the primary applicant which is myself so if I get ALL my dependets get it as well but just wanted to be double sure hence this question!!

Thanks..
