ILR (Indefinate Leave To Remain) For Me & My Wife

Hi,

I entered in UK in 2004 & got HSMP in Aug 2007, Tier(1) in Aug 2009 & my ILR is due in Aug 2012.

I got married in Sep 2010 & my wife came to Uk in Jan 2011 as Tier1 Dependent & we blessed with a child in Oct 2011. My question is

1. As it will be 1 year / 7 Months in UK for my wife so Which Visa she will go & which forms I have to filled for her ?

2. When she can apply for her ILR ?

3. I spent 176 days (166 holidays / 10 business) out of UK. All 176 on Paid leave & I pay slips / P60 for last 5 years. Is there any other documents I need to show for 176 days outside of UK ?

Since your absences are under the 180 limit. You do not need to get any letters in support of these absences.

Regarding your wife, as she has not spent 2 years yet in UK she will have to apply for an extention and cant get ILR at present. You will need to fill FLR (M) form for her and I guess same for your child too (i am not sure bout the child though). Once she completes her 2 years in jan 2013, then you can apply for ILR for her.

Since your total days out is less than 180 and i guess you havent been out of UK for more than 90 days in a single stretch it should be fine.

I think

For my Wife - She will go on FLR(M) in August. Jan 2013 it will be 2 years for her in UK then I can apply for her ILR.

For Baby - Baby can go on ILR with me in August 2012.

180 Days rule - As my personal days are 166, 8 days for business for it looks like i will be fine as i do have pay slips, letter from employer for business, P60 for last 5 years.

If baby was born in the UK, then baby may skip ILR. Register baby for UK citizenship immediately after you're granted ILR.

Vinne, I do have a excel sheet for my absences. As 166 was holidays but all paid so do i need to prepare anything for it, do i need to mention it in the cover letter ?
