applying for 10 Year ilr with a gap

hi
my story
- entered uk in jan 2002 on a student visa, all subsequent extensions made on time and successful
-2009 applied to be a dependent on my partners asylum got discretionary till may 2013
(however sent a wrong form oct 2009 due to a lawyers ill advice who gave me that form, form only returned as invalid jan 2010 by ho and given 28days to resend application on correct form, granted discrtionary leave to remain 3yrs may 2013)

will i be able to apply for 10year ilr long residence?
does this gap hinder my chances or if i explain it was my lawyers fault in a cover letter could they use discretion.

You have no gap as long you reapplied within the 28 days given to you.
