ILR Requirement- Time Period- Came UK after 90 Days

I got HSMP visa on 21st July 2008 and Landed in UK on 21st OCT 2008 for the first time. I got extension in Tier 1 category on 28th of July 2010. My Current leave under Tier 1 is expiring on 28th of July 2013. can i apply for Indefinite leave in July 2013? i have a solid income of 37000£ and qualify all other requirements but only worried about time period as Set O guidance notes advise for one more extension if someone has arrived UK for first time after several weeks. i am unable to understand the Term SEVERAL WEEKS. can someone help?
