5 points less in Point based Calculator

Dear Friends
Is there any case where someone fell short of qualifying points & still manage to get PR, Tier 1 Visa?
In my case i'm scoring 70 points though I need 75. I am looking for options.
Age:20
Qualifications: 0 (Bachelor's degree is not counting in my case & I don't have Masters)
Previous earnings:45
UK experience: 5
Total Points: 70
Do you guys think contacting solicitor would help?
Any advice would be great

What do you mean Bachelor's degree is not counting ??? how did you get your Tier 1 extension previously ? What was your points breakdown then ?

I switched to Tier1 from WP at that time I got 35 for bachelors degree but now Masters is minimum because of the rules change.
If i try to score using calculator its not considering my bachelors degree anymore.

the same rules you used when you apply for the first time, apply now.
so if you have the exact same situation as you where when you applied first time.
then you should pass second time

As long as you successfully claimed points (even once) in your previous application(s), you will get the same points at the time of ILR.
This is true even for the Bachelors Degree. If you got 30 points in your previous application, you will be fine at the time of ILR.
You don’t even need to provide the degree again, just tick the option which says “evidence provided in the previous application”.

Just opening this topic but this time its for wages. In section 9 this note is tricky for my application:
* You can only claim points for earnings below £20,000 if you have had leave to enter or remain as a Writer, Composer or Artist, Self-employed Lawyer or a Tier 1 (General) Migrant; and that leave was granted before 31 March 2009.
[I got my Tier 1 after 31th March (please read description below on which circumstances I got my Tier1). Does that mean i can score points based on the above extract? ]
Tier 1 application submitted on 12/01/09 which was refused on the 25/02/09. The application was refused as the degree certificate that was submitted was not the original degree certificate. This was the only reason that the previous application was refused.
Reapplied for Tier 1: 24/04/09 Tier 1 Granted

If your initial tier-1 successful application/extension counted the degree and awarded the point then you must get the same point for the degree now.

Since you made your application after the 31st of March 2009 you will not qualify for claiming points for less than P20000. Your application is treated as a fresh applicatiion.
PS. I thought you already were claiming 45 pts for earnings? If thats the case then it looks like you have all the points you need for ilr

No my salary changed and I am on less wages now!
But that's quite interesting because I can claim points for my qualification(which i'm happy about) though i received my Tier 1 after 31th March but in terms of salary rules seems to differ....
Any moderator would like to share their expertise??
