Hi,

I came to UK on 17th March 2007 under work permit and changed it to Tier 1 in Feb 2010 (its still valid till Feb 2013) . My wife joined me in April 2007 and was in UK with me until 28th June 2010 (in Tier 1 dependant).
She went to India on 28th June 2010 for delivering baby and going to join me again on 25 th March,2012. That means she lived in UK for 3.2 years (April 2007 - June 2010) continiously and have a break of 1.9 years.

Now I am elibgible to apply for ILR on Feb 17,2012 (28 days prior to completing my 5 years on 17 th March 2012).

In this scenario, can I apply for ILR for my wife also ? If not, what visa I need to process for my wife ?

Please clarify. If you require any further info, please let me know.

Thank you very much

Regards
RD

You need to apply for her an extension as she is not elibgible to apply for ILR due to her absence

I think that she may apply for ILR with you.
