Employer letter - Income threshold

Hi,

I am in the UK on tier 2 PBS and my husband is on dependent visa.

My query is if I need £38K salary(yearly) for ILR (as per the code of conduct) and my basic salary is £31K (yearly) and I am getting around £7.2K (monthly £600) from OT/support .
IF I calculate whole year's gross salary from my pay slip, it wll be more than £38K which I need for ILR. But my £ £600( OT/support pay) is not consistent. But it will be more than £7.2K (yearly)

Will this be consider as per the standard of COC ?
My Employer is going to mention £31K(Basic salary) on their letter. Will it be any issue with my ILR ?

Hi,

You will be able to claim points for 38K and there is no doubt about that. As far as employer’s letter can you not ask them to write a letter saying, your earning between the period of X and Y was 38K. This is what I did for my renewal and that way you can easily include your OT payments.

I think if you ask them a letter confirming your historic salary then they will not have any issues with that.

You can give them photo copies of your payslip for the last year so that they don’t have to bring it up on the system.

what does your contract state? is the ot payment discretionary or included in the package?
in my opinion this could be a potential issue especially if the employer only state the basic salary.

Sorry for delay in reply... Just came from the vacation...

Spoke to my Employer and they are going to mention only Basic salary..
Need to apply for ILR in Aug..
