ILR Eligibility

Hello Experts

I have a collegue of mine who would be finishing 4 years 10 months and 17 days on 28th April 2012. His tenure in UK is as below

Arrived in UK on Tier 2 Work Permit : 10th June 2007.
Held Work Permit Tier 2 Visa between 10th June 2007 to 27th April 2009 = 1 Year, 10 Months , 17 Days

Holds Tier-1 HSMP Visa since 28th April 2009 till 28th April 2012 = 3 Years

In Total : 4 Years, 10 Months, 17 Days.

Considering his case,would he be able to apply for a ILR say few days/week before 28th April 2012 as he would be completing 4 years 10 months and 17 days on 28th April 2012.

His concern is that he is short by 14 days for a direct ILR application with his existing HSMP valid until date. Could he apply for a ILR directly instead of a Tier-1 extension, just to suffice few days of shortfall. Thanks

Posters who request comments from experts (presumably to the exclusion of all others) should not be surprised when they receive no comments. I am not an expert so presumable you can ignore my comment but I'll make one in any case.


I don't see how it will be possible. His shortfall is not the result of a late arrival of less than 3 months with leave in the same category. He will have to extend.

My apologies if my method of salutation gave a incorrect perception. I had no intention to exclude anyone.
