ILR dependants Visa query

Dear all,

Thanks for this wonderful forum and its great helpful community.

I came from India to UK on Aug/2006 on a work permit, then to HSMP and now i am currently on Tier 1 General Visa. I have required points to apply for ILR and i am planning to apply for ILR.

But i have some questions about the dependents visa:

My visa expiry date - 08/10/2012
My wife's visa expiry date - 08/10/2012 (Tier 1 dependant)
My wife came to UK on 10/05/2010
My baby was born on 03/10/2011

1. I believe that if i am making my application now, my wife need to apply for FLR either along with me or within 28 days from my ILR approval? is that correct?

2. Or if i wait for a couple more months, my wife would have completed 2 yrs in UK and me & my wife can apply for ILR together?

About the baby, i didn't apply for ILR by the time he was born though i was qualified (i still haven't applied yet). I have just registered his birth and haven't applied for indian passport. So what should i need to do about him

3. Should i apply for indian passport, apply for FLR/ILR along with my wife?

4. or Is there a way to obtain british passport for him?

Your expert and experienced opinion is much appreciated.

1. If you are granted ILR before your wife is eligible for ILR, then she must apply for FLR(M).

2. You may wait and apply for ILR together when both you and wife are eligible.

3. If not travelling, then baby (born in the UK) is not required to apply for leave to remain.

4. After grant of registration.
