ILR success croydon 23/03/12

I and my wife were granted ILR today at croydon.

It was tiring and stressful wait of 6 hours at peo but finally got results we wanted.

I applied on the basis of WP + Tier 1

Surprise thing caseworker told me that I should claim same points as in Tier 1 application even if it is above 75( in my case it was 85).

I just made into same earning band by difference of £50, she told me that had I fallen in one band below she would have refused application even total points were going to 80. This was not expected but feel lucky now.

So what is the REAL RULE?
And how do we calculate point? using point calculator?

Guidence rules clearly says that you should be able to score 75 from relevant table but I remember another applicant also shared same experience on this forum almost month ago.
I think it's really confusing and unfortunately depends on caseworker.

I've appointmet on 4 April with the same case (wp + tier1) - can you please let me know which documents did you submit for WP period ??

Employer leter(I was with same employer for 5 years)
12 months pay slip
5 P60
HMRC employment document covering 5 years
Birth and marriage certificate
12 months bank statements
Absence sheet(downloaded from this forum)
Spouse 24 months bank statements, last 3 yeas council letters and other letter to prove her 2 years with me
Mortgage documents

I had more documents like older pay slips etc in my other file but she did not ask for any

Life in Uk test for myself and wife
Work permit documents and visa letters from home office

What do mean by "HMRC Documentation". Is it becuase you have been a contractor?

Can someone really confirm the rule regarding the same amount of points?


If I have to claim the same amount of points I will have to wait 12 months and show that many payslips.

If I dont have to claim exact same points as last time then I can apply much earlier.

It is employment history document which is available on request from HMRC for required period. It is beneficial if P60 is missing otherwise not needed. See sticky post about missing P60

I believe this case was only reported with couple of applications( this is what i think from forum) at croydon. Avoid it if you can, just thought

Quick one .... is the 12 months from last 15 months still valid? ... which means I can be unemployed while applying for ILR as long as I am able to meet point system for 12 (or less) months from last 15 months? ....
