Dear Friends,

Here is my scenario , please help me to figure out whether I am eligible for ILR on/after 8th May

1.) Got work permit in aug 2006 ( valid for 5 years)

2.) Initial came to UK on 2nd June 2007 , via work permit ( wp was valid till sept 2011)
3.) Returned back India on 2nd June 2008
4.) Came back now with Tier 1 G on 10th Aug 2008

i stayed continously at India from 2nd June 2008 - 10th Aug 2008 which is less than period of 90 days - this should be OK ?

and in total from 2nd June 2007 till date no. of days outside UK is less than 180 .

I complete 5 Yrs on 2nd June 2012 so minus 28 days from the same = 8th May

My calculation says I shoule be eligible on/after 8th May - Is that correct ?


Please take out some time and help me .

Looks fine.

You should try and get a letter from employer that the missing 90 days was because of work/assignment in India

It was less than 90 days ( 72 days ) so letters is required from Organization or without letter should be ok.

In that days I received Indian salary so does not unnecessary create confusion.

Why did you go back to India in June 08? We're you still employed by the employer who sponsored you WP during that duration?

Yes, same employer .

It was just official work at india for that duration , in the meantime I thought to apply for Tier 1 G .

Actually I got approval letter at UK but all of sudden in June I travled India so did apply for Tier 1 from India.

I am with same employer since 2005 till date.
anyway no. of days during that stretch were 72 days and in total less than 180 in 5 Yrs.

Please advise
