Her husband is German and she holds a German residence card. Therefore the residence card can't be under 2004/38/EC unless the husband exercised free movement in the past (unlikely, but possible). Well spotted. In the event that it's a document issued to a German national's family member who'd never exercised treaty rights, then it would be called a permit.
