Applying for EEA3

Post by maganit » Mon Jan 06, 2014 7:17 pm

Hi Everyone!

I am applying for EEA3 with my husband and I have a problem. I came to UK in September 2006 and I started to work in begin of November. I didn`t apply for WRS, because I thought I was working illegal (we got cash in the coffee bar). After a couple of month later we found out we worked "part-time" on paper so I registered on April 2007. The application was not correct so Home Office refused it. I applied again on May when I worked with agency. Since that I had my all paperwork correct. My question is which way is better:
1) if I will be honest and I use correct dates in my application (and they might refuse it due to "not registering to WRS") or
2) if I will use that day when WRS was accepted (and they might refuse it if they had my previously application plus lying)?
I think both way could be risky just I don`t know which less?

Thank you every help!

(2) is better.

Why do you think it would be an issue that you got refused before? Why would the HO think you are lying? You can choose any date you wish to be your starting count of the 5 years (as long as this is within the rules).

If you have worked legally for five years, you have permanent residence as fact. The certificate would merely confirm that.

I read that HO can refuse EEA3 if you didn`t apply for WRS properly. In another forums they said HO refused it due to that reason. I had a refused WRS apply at the beginning so that is why I was worried. I didn`t know yesterday if you didn`t have job for more than 30 days within 12 months you had to apply for WRS again and start 12 months again. So I think in that case I will be fine, because I had some time between the applications. :) Finger cross.
