Hello everyone.

I have gone through this forum but couldn't be clear about my query.
I am on EEA2 and got separated after 2 years of marriage.
Do I need to inform UKBA about my separation? My wife is willing to help me so can I live separately for a year before applying for divorce? Is it perfectly legal if I do that?

Any help will be much appreciated.

If its not formal separation by not involving court then its informal separation then you will still be eu national family member. If she help you with treaty rights evidences then you will be fine.

but never you make any mistake by informing the HO that you are separated. don't even mention it.when your marriage is 3 years old apply for your divorce. not everybody especially the home office would understand that relationships or marriages could break down at any point in life. so check the requirements for retained rights and ensure you have everything before contacting the HO.
