Hello all,
I have been silently following this board for a year now and GENUINE THUMBS UP for you guys.
I will like to get advice from the gurus on where on here about how to withdraw EEA(EFM) and replace with EEA(FM). I have to do this myself as i cannot afford anymore solicitor's fee. I an non-EU and was an overstayer before my EEA 2 application.
My details are below:
EEA EFM applied: 13/07/15
COA received: 31/07/15 (no right to work)
Bio letter received:19/08/15 enrolled: 24/08/15
Gave notice of marriage:09/10/15
Home office decided to investigate (we only received letter asking for our email addresses and phone number)
Home visit:15/12/15
Letter confirming we complied with the marriage investigation and to go ahead and marry received: 18/12/15
Married: 21/12/15
Sent Home Office marriage cert: 23/12/15
So far it has been over 6 months and no sign of my RC. I have been in touch with my MP who contacted the Home Office on my behalf and the response was that i have to carry on waiting. I have missed for great employment opportunities since the end of December so now i have decided to withdraw the EFM application and apply as FM.
All possible contributions will very much appreciated.
Regards,
Adrian

No point withdrawing anything.
You could send the marriage certificate and asked them to give consideration to that.

Thanks for swift reply Obie,
I sent my marriage cert via my lawyer on 23/12/15 with a letter asking them to consider it. Didn't get any response.

One of the clauses on the application form/guidance states any material changes since application have to be notified to HO.
You could write with your updated information & appropriate evidence (eg marriage certificate) cross-referencing original application.
(Congratulations btw).

Thanks noajthan marriage has been great fun so far.
A letter was sent by my lawyer together with my marriage certificate on 23/12/2015 and it referenced my original application. (i have a copy of the letter so i am certain what was written in it).
My problem is that i really need to get back into work and it is very tough trying to convince employers that i am legally allowed to take employment.

**Quick update**
My application has been refused with right of appeal.
Reason for refusal is that my sponsor is on a casual contract and claiming housing benefits.
They also mentioned that she works 20.03hrs per week and earn £146 per week (both statements are not correct).
I am torn between appealing and re-applying; any ideas please
Thanks in advance
