SS Route with non-visa, non-EEA spouse

Hi Boarders,

I am just after some opinions and perhaps advice on my/our situation.

I am a UK citizen/national and have a non-visa, non-EEA spouse of over 3 years. We have been living in Ireland for almost 5 months, having moved directly from outside the "EEA", where we previously lived for 5 years.

We are very shortly going to apply for a Family Permit, and while we are quietly confident it will be granted, it does seem from other forums etc. that the number of refusals is increasing - and the reasons for them are becoming more and more ridiculous.

So, I am thinking of Plans B, C and even D. Do we:

1. Wait for the Irish RC we applied for (assuming we get it), go to the UK with that, then apply for a UK RC?

2. As my spouse is non-visa, should we just go to the UK and apply for a UK RC under Treaty Rights once there? Any difficulties in this?

3. Turn up at immigration and ask for a EEA Dependant (old 1A) stamp?

4. Forget it, and go to a country that wants me?!
