ROR application

Hello everyone,

I believe there are no much people who applied for retain right of residency
I just want to know what are the common reasons of refusal by HO ?
anyone is waiting decision on this type of application or had a second RC after divorce already ?
does HO treat ROR application more strictly ?

any answers will be really helpful...

If you search forum you will see there are many.
Many EU-related marriages seem to end just after 3 years and then ROR is filed for.

Refusal is given when requirements are not met; same for all EU-related applications - its very binary.
HO is not 'strict' nor vindictive nor personal; HO applies the Directive as transposed into UK law.

Fulfill requirements: succeed;
fail to fulfill requirements: fail;

It is not always the case that refusal are issued when requirements are not met.

That may be the case in some cases but not in all.


There are many ROR refusal I have seen, which are clearly pereverse. That no reasonable civil servant who focuses on the law will make.

If that contention is correct, then the whole appeal system may well be Nugatory.


I have seen refusal on grounds of marriage of convenience, when couple had kids before they divorce.

I have seen refusal on the basis that an EEA national was not exercising treaty rights at time of divorce, even though a document certifying permanent residence was provided.

The decision are sometime so disheartening that I feel the need to resort to anti depressant medication.

the reason of refusal are ridiculous ,
do you agree is all because of the ignorance and lack of experience for case workers? or just they want you to run to courts and solicitors ?

Ho receive 13-June
Payment taken 14 June
Biometric send 12 July
Biometric send 12 July
COA with work 20 August
ROR ????
Doc received ?????
