EEA Family Permit Extended Family refused - Please Help!

Hello Everyone,

I have hit a wall with the EEA FP application for my sister and I am really hoping someone can guide me in the right direction here.

I am German national, living and working in the UK for the past 6 years and holder of permanent residence.

My sister lives in Pakistan with my aunt and uncle since both my parents have passed away. I have one brother who is married and lives separate with his family.

I applied for FP for my sister as 'Extended family member' and as proof of 'financial dependence', I had submitted receipts of money transfer. The transfers however were in my mum's (who has since passed away) or my brother's name. This is because I come from a conservative village and it is practically impossible for an unmarried woman to travel to the city to collect money. They can't do it in the village because there are no bank branches there.

It was refused because ECO wasn't convinced my sister is dependent on me and in refusal letter, he/she mentioned the fact that money transfers were not in my sister's name. I had of course explained in the cover letter why was that so, but apparently he/she hasn't bothered to read any of the explanations.

My sister also had her right arm disabled in a traffic accident last year and needs help to perform her daily chores, this was also mentioned in the letter along with pictures and letter from the doctor to confirm, but again apparently ignored.

The refusal letter says there is no right of appeal because she didn't prove the financial dependency so I am thinking of applying again. The issue I have is that I still don't have receipts of money transfers in her name which I can start doing, but would then have to wait a few months.

My questions are:

- How long do I need to wait before I can apply again with sufficient proof of financial dependency? I guess 3 months but not sure.

- And I know this has been asked a million times before but I haven't managed to find an answer, what else apart from the money transfer receipts can I provide to prove financial dependency? I have a feeling they don't bother reading what you write in cover letter.

I had applied for EEA Family Permit for my sister who is financially dependent on me. The first application was logged in April 2017 but was refused on the grounds that ECO was convinced of financial dependency. I re-applied providing additional evidence of the dependency.

This has been refused again, this time because of 'lack of evidence of relationship'. I had provided birth certificate of myself, my sister and the death certificates of both my parents. While they have acknowledged that, they have deemed this is not enough!!

The letter states:

'As evidence of your relationship with (my name) you have provided your birth certificate and your sponsor's birth certificate. However these were registered on the 19th April 2017.

You have provided no historical documentary evidence of their birth or DNA Test Results to show that you and your sponsor are related as claimed. In view of your failure to provide satisfactory evidence, I am not satisfied that you are the family member of an EEA national in accordance with Regulation 8 f the Immigration (European Economic Area) Regulations 2016'

I had no idea that DNA tests were required or what 'historical documentary evidence' I can provide to prove that my sister is my sister!!

Surprisingly, they have given the right of appeal that states 'You are entitled to appeal against this decision under regulation 36 of the Immigration (European Economic Area) regulations 2016. A notice of appeal is enclosed what explains what to do.....'

My questions are:

I thought an EFM refusal under 2016 regulations didn't attract right of appeal so has the ECO made a mistake and appeal cannot be lodged?

Should I appeal anyway and take it to the conclusion or should I lodge a fresh application?

The reason for refusal is ridiculous to say the least. If someone can please offer any advice, I would be very grateful.

i recently applied for my Mum, Dad and sister and alhamdulillah it was granted after 2 years of fight. My initial objection was one of them but i attached my family certificate from Nadra attested By foreign affairs and plys i attached my birth certificate and my family ones and that done the job and now recently i applied for 5 years extension from the uk for them so waiting for that decision.
